At Kavita’s Kreations, our number one priority is providing you an excellent service with quality products.  This section contains all our Terms and Conditions.  Please read it carefully and if you have any questions, please do contact us.

General Terms and Conditions

• All prices are in Australian dollars
• GST is not applicable and is not charged for any of our products and services
• All prices and products are subject to change without notice
• A deposit of 50% is required for the commencement of design work
• An initial draft will be provided to you for approval
• Basic changes can be made to the product based as per our Change Policy
• Major changes such as adding additional photos, redesigning, etc. will incur an additional charge
• Upon finalisation of the product, full payment will be required
• All content will be provided by you and you confirm that you hold the copyright over all the content that is provided to me.

• Your access to and use of all information on this website is provided subject to the following terms and conditions.
  
• Kavita’s Kreations reserves the right to amend this Notice at any time and your use of the website following any amendments will represent your agreement to be bound by these terms and conditions as amended. Kavita’s Kreations therefore recommend that each time you access this website you read these terms and conditions.
  

• There is no legal minimum age requirement to browse this website. However, anyone below the age of 18 should obtain parental consent in using my services.  Kavita’s Kreations strongly recommends that parents and guardians supervise their children's use of the Website.
• All prices are in Australian Dollars (AUD). Kavita’s Kreations will try to keep the price list current at all times. The prices for the products can be amended at any time without prior notice.  If you have placed an order, Kavita’s Kreations reserves the right to cancel your order should our prices change.

• The products Kavita’s Kreations offers are described as accurately as possible on our website, however Kavita’s Kreations does not warrant that the description is accurate. Where Kavita’s Kreations becomes aware of any inaccurate descriptions, we reserve the right to correct any error or omission.
• The images on the website have been provided for illustrative purposes only and Kavita’s Kreations does not guarantee that any image will reproduce in true colour nor that any given image will reflect or portray the full design or options relating to that product.

4.  Slideshows

• All Slideshows which have been ordered for events should be tested on the media that you will be using for the event, prior to the event.  Kavita’s Kreations will not be held liable, if the slideshow does not work during your event.
• Where there is an issue with the DVD provided, Kavita’s Kreations will provide you with another copy of the DVD.  There will be no refunds provided unless Kavita’s Kreations can’t provide you with a working copy of the slideshow.
• All content (graphics, images, music, etc.) provided for the slideshow should be of a reasonable quality.  Kavita’s Kreations will not be held liable, for the quality of the content provided.  For details regarding the quality of the content, please view our FAQ page.
  

• All content (graphics, images) provided for the books should be of a reasonable quality.  Kavita’s Kreations will not be held liable, for the quality of the content provided.
• There might be a slight colour variation in the final printed job.  This is not considered a manufacturing defect and refunds due to this will not be given.  A manufacturing defect will be constituted if there’s a major difference between the content provided and the final print, i.e. a normal photo is very dark.

6.  Invitations

• All content (graphics, images) provided for the invitations should be of a reasonable quality.  Kavita’s Kreations will not be held liable, for the quality of the content provided.

• All content (graphics, images) provided for the flyers should be of a reasonable quality.  Kavita’s Kreations will not be held liable, for the quality of the content provided.

• All content (graphics, images) provided for the collages should be of a reasonable quality.  Kavita’s Kreations will not be held liable, for the quality of the content provided.

• In the event, that a product has been listed at the incorrect price or with an incorrect description or image due to typographical error or oversight, Kavita’s Kreations reserves the right to cancel a transaction.  If Kavita’s Kreations has obtained payment from you, we will immediately refund your money card for the total amount obtained.

10.  Product Returns

• In the event of a manufacturing defect, Kavita’s Kreations is happy to refund your money.  You will need to contact us within 7 days of receiving the product.
• A final version of the product will be shown to you before Kavita’s Kreations finalises the product.  Kavita’s Kreations does not refund if you simply change your mind or if there are any customer generated mistakes.

13.  Disclaimers

• While Kavita’s Kreations has ensured that the information provided on our website is accurate, we do not provide any warranty either express or implied including without limitation warranties of title or implied warranties of merchantability or fitness for a particular purpose.
• To the extent permitted by law, any condition or warranty which would otherwise be implied into these terms and conditions is excluded.
• Kavita’s Kreations also ensure that our website is free of any virus, worms, Trojan horse and/or malware.  Kavita’s Kreations is not responsible for any damage to your computer system which arises in connection with your use of our website or any linked website.

14.  Limitation of Liability

• To the full extent permitted by law, our liability for breach of an implied warranty or condition is limited to the supply of the goods and/or services again or payment of the costs of having those goods and/or services supplied again.
• Kavita’s Kreations accepts no liability for any loss whatsoever including consequential loss suffered by you arising from products we have supplied.

15.  Indemnity

• By accessing Kavita’s Kreations' website, you agree to indemnify and hold us harmless from all claims, actions, damages, costs and expenses including legal fees arising from or in connection with your use of our website.

16.  Change Policy

• A first draft of our product design is provided.  At this point, you can make changes to the products such as rearrange photos; add/edit text, etc.
• There is a maximum of 2 rounds of changes Kavita’s Kreations will make to your product.  Any more changes will incur a fee of $50 per hour or part thereof.
• If you want to change the entire design of the product, this does not come under the Change Policy and will be charged out at the rate of $50 per hour or part thereof.

17.  Jurisdiction

• These terms and conditions are to be governed by and construed in accordance with the laws of Victoria and any claim made by either party against the other which in any way arises out of these terms and conditions will be heard in Victoria and you agree to submit to the jurisdiction of those Courts.
• If any provision in these terms and conditions is invalid under any law the provision will be limited, narrowed, construed or altered as necessary to render it valid but only to the extent necessary to achieve such validity. If necessary the invalid provision will be deleted from these terms and conditions and the remaining provisions will remain in full force and effect.
